These Terms govern your use of alwaysquestioning.com, operated by Always Questioning LLC ("AQ," "we," "us"). This is our current policy and we refine it as the collaborative grows.
1. Acceptance
These Terms govern your use of alwaysquestioning.com and related pages, forms, and communications (the "Service"). By using the Service or submitting anything to us, you agree to these Terms, the Community Guidelines, and the Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old. The Service is intended for adults and is not directed to anyone under 18.
3. What Always Questioning is
We are a creators collaborative and a directory. We list independent work and link out to each maker's own store and checkout. We are not the seller of, and do not process payment for, listed makers' products, and we take no cut of their sales. We also run a Member board where people can post to find collaborators.
4. Accounts
Reading requires no account. Becoming a Member requires signing up with an email. You are responsible for your account and for keeping your login secure.
5. Your content on the Member board
You keep ownership of what you post. You grant AQ a non-exclusive, worldwide, royalty-free license to host, display, and distribute your posts on the Service for the purpose of operating it. You represent that your posts are yours to share, are accurate, and do not infringe anyone's rights or violate the Community Guidelines. We review posts and may edit, remove, or decline any content, and may suspend or remove accounts, at our discretion.
6. Listings and third-party sites
Resident listings link to makers' own sites and checkouts. Those transactions are solely between you and the maker. We are not a party, are not responsible for third-party sites, products, fulfillment, or disputes, and make no warranty about them.
7. Our intellectual property and the Commons
The Service, the Always Questioning brand and marks, and our own content are owned by AQ or its licensors. Any content we offer under the Always Questioning Commons is governed by the separate Commons license. Nothing here grants rights beyond that.
8. Acceptable use
Follow the Community Guidelines. Do not scrape or bulk-harvest the Service, use it to train machine-learning models, reverse engineer it, or use it unlawfully or to infringe others' rights.
9. Copyright and takedowns
We respond to valid notices under the DMCA. Send notices to [email protected] with the elements the DMCA requires. We may remove content and terminate repeat infringers.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, including for third-party listings and any content posted by users.
11. Limitation of liability
To the fullest extent permitted by law, AQ will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, revenue, or goodwill. Our total liability for any claim will not exceed one hundred US dollars.
12. Indemnification
You will indemnify and hold AQ harmless from claims arising out of your posts, your use of the Service, or your violation of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Nevada. Any dispute will be handled under the dispute-resolution process we post; where none is specified, disputes will be resolved in the state or federal courts located in Nevada.
14. Changes
We may update these Terms and will change the "Last updated" date above. Material changes take effect when posted. Continued use means you accept them.
